Estate Planning

In-depth planning is the focus of Wilson Elder Law Center. Asset protection is not just about what happens to your assets after you pass away; effective asset protection estate planning looks at all issues- from disability to Medicaid, Veteran's benefits, nursing home care, and death.

As we grow older, one of the greatest fears we face is running out of money.  One of the mantras of Wilson Elder Law is, “If you’re out of money, you’re out of options.” We do not want you to run out of money and will work diligently to legally protect your assets.

We assist clients in planning for possible long-term care needs, including nursing home care. The attorneys and staff of Wilson Elder Law Center will provide you with comprehensive options that will allow you to control your assets while you are alive and well. The planning also provides for your loved ones if you should become disabled, and upon death, gives what you have to whom you want, when you want and how you want.

Certainly one of the most fearful times for families is considering long-term care for a loved one and how to pay for that care. All the myths about Medicaid tell you that you will lose your home and all of your money, but that is simply not true. Similar to the deductions and allowances available to you when you file your income taxes, there are legal means to protect some or all of your assets when qualifying for Medicaid.

The most important thing to remember about qualifying for Mississippi Medicaid is to seek the advice of an attorney that understands the complex and sometimes confusing Medicaid rules. Not doing so could result in losing assets that you do not have to lose.

Our approach to asset protection always includes educating the client about the basic differences between a will and a trust and how and when each one works.  Our detailed planning options also include preparing appropriate health-care directives (for medical and health-care decision-making) and durable general powers of attorney (for financial affairs decision-making).  All of these critical, but often overlooked legal documents, are to permit decision-making by others in the event of incapacity.

Why is Wilson Elder Law qualified to help me with asset protection? Our attorneys have assisted hundreds of families develop the appropriate plan to address their unique issues. Our attorneys are committed to asking the proper questions, then listening to your story and your concerns. They ask questions you may never have considered, but are critical in developing the best strategy for your family.
